1. Introduction
Welcome to HomeConnect AI ("Company", "we", "our", "us")! These Terms of Service ("Terms") govern your use of our website and services (collectively, "Service") operated by HomeConnect AI. Our Service connects homeowners with independent service professionals, including individuals and companies ("Professionals").
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information. Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood the Agreements, and agree to be bound by them.
2. User Accounts and Roles
You may register for an account as a "Homeowner," an "Individual Worker," or a "Company." You must be at least 18 years old to create an account. You are responsible for all activities that occur under your account.
- Homeowners use the Service to post job requests ("Jobs"), receive bids from Professionals, and manage their projects.
- Professionals (Workers and Companies) use the Service to create profiles, find Jobs, submit bids, and communicate with Homeowners.
3. Job Postings, Bids, and Agreements
As a Homeowner, you are responsible for the accuracy and completeness of the information in your Job postings. Posting a Job does not obligate you to hire a Professional.
As a Professional, your bids are binding offers to perform the work described. When a Homeowner accepts your bid, you enter into a direct, legally binding contract with the Homeowner. HomeConnect AI is not a party to this contract. All aspects of the job, including scope, quality, and payment, are between you and the Homeowner.
4. Payments, Fees, and Subscriptions
While posting a job is free for Homeowners, Professionals may be subject to certain fees.
- Subscriptions: Professionals may purchase subscription plans ("Pro," "Business") that provide access to additional features, such as more leads and advanced analytics. Subscription fees are billed on a recurring basis and are non-refundable except as required by law.
- Ad Boost Tokens: Users may purchase "Ad Boost Tokens" to promote their job postings or professional profiles. Tokens are non-refundable and have no cash value.
- Service Fees: For jobs paid through our future secure payment system, HomeConnect AI may charge a service fee to the Professional. This fee will be clearly disclosed before the transaction is completed.
5. Use of AI Features
Our Service uses artificial intelligence (AI) to provide features like job categorization, recommendations, and content generation (e.g., bios, messages). While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should independently verify all information before relying on it. HomeConnect AI is not liable for any decisions made based on AI-generated content.
6. User Content and Conduct
You are solely responsible for all content you post, including job descriptions, bids, reviews, and messages ("User Content"). You agree not to post User Content that is false, misleading, illegal, or infringes on the rights of others.
We reserve the right, but are not obligated, to remove or edit User Content that violates these Terms.
7. Reviews and Ratings
After a job is completed, Homeowners may leave a public review and rating for the Professional. Reviews must be truthful and based on your firsthand experience. We reserve the right to remove reviews that violate our policies.
8. Dispute Resolution
Disputes between Homeowners and Professionals are to be resolved directly between the parties. HomeConnect AI may, at its sole discretion, offer mediation services but is not obligated to do so. We are not responsible for any damages or claims arising from disputes between users.
9. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. HomeConnect AI does not guarantee the quality, safety, or legality of the services provided by Professionals. We are not responsible for the conduct of any user of the Service.
To the fullest extent permitted by law, HomeConnect AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
10. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including a breach of these Terms. Upon termination, your right to use the Service will cease immediately.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
12. Platform Support Scope
HomeConnect AI provides customer support for issues related to the functionality of the platform only (e.g., account access, technical errors, subscription billing, or policy violations). We do not provide support for disputes, complaints, or claims regarding the performance, conduct, or services of Professionals. Such matters must be addressed directly between the Homeowner and the Professional.
13. Insurance and Guarantees
HomeConnect AI does not provide, verify, or guarantee insurance coverage for any services offered by Professionals on the platform. Any insurance terms, guarantees, or warranties are solely between the Professional and the Homeowner.
14. Indemnification
You agree to defend, indemnify, and hold harmless HomeConnect AI, its affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from (i) your use of the Service, (ii) your violation of these Terms, or (iii) your interactions, contracts, or disputes with other users of the Service.
